Tim Horton’s Scooter Chair – Follow Up

I had just posted this post A Different Drive-Thru Experience just a few days back, tonight I was reading the CBC’s website and came accross this story – “Disabled man argues no access to Tim Hortons drive-thru violates human rights“.  Seems that in Nova Scotia a disabled man who uses a scooter, just like the guy I took a picture of in Langley BC has been denied access to the Tim Horton’s drive through as Tim Horton’s apparently have a policy banning people, bicycles and wheel chairs including motorized scooters from the drive through.

Clearly news of this policy has not reached the Tim Horton’s in Langley where I took the picture.  Interestingly, according to the CBC website’s article, Tim Horton’s spokesman David Morelli stated that the policy is in force as it is too dangerous to have scooters in the drive through lane as some patrons drive fast while leaving the window, while adding that he will be reminding all Tim Horton’s stores of the company policy, so I guess the guy in my picture has his days at the Tim Horton’s drive through numbered.

I have just one comment though, why would their policy be based on people driving to quickly when they leave the window?  This seems to be pure conjecture created by a lawyer that is scared of a liability law suit. I suspect that if any careless driver chose to spin his wheels leaving the Tim Horton’s window, late for his 8:15 meeting and coffee in hand collide with the man the just drove away from the window on his powered scooter, that driver would probably face the wrath of the Canadian justice system, and that the spilled coffee would be the last of his problems.  I also fail to see how liability for the man colliding with the scooter could be placed somehow on Tim Horton’s shoulders, other than that the incident technically may occur on their property – but then I am not a lawyer.
